After examining the pages carefully, I feel quite certain that Nicholas Roerich did not write this application himself. It must have been made here in New York, by his helpers, and then sent to him for his signature. In any bureaucratic context, letters and forms follow certain rules, and when applying for a patent, copyright, or trademark, the applicant must state that he has no knowledge of any previous use of the material that he is claiming as his own, and must state that the material is his own creation. But I am sure that Nicholas Roerich would not have known how to properly use those small rules of expression.
Of course, the symbol was seen in many variant forms by Roerich, for many years. But this particular variant, the three dots in a circle, in certain proportions, in a particular color, could have been the first use. There is room in this for interpretation.
